Не осуществились надежды культа MuellerAnon. Расследование Мюллера завершено.

Осуществилась ли угроза номер пять, о которой я писал в декабре 2017 (бесплодное окончание расследования Мюллера)?

Окончательно говорить пока рано. Факт российского вмешательства и его преступной составляющей Мюллером установлен. Завершение расследование без предъявления обвинений американским сообщникам этого вмешательства - не то, чего ожидали не только поклонники культа MuellerAnon, но и многие комментаторы из числа профессиональных юристов и бывших прокуроров.

Законом возможности Мюллера ограничены - он мог сообщать публике о выявленных фактах только путем предъявления обвинений и развернутых обвинительных заключений. Финальный отчет с обоснованием всех решений по выдвижению обвинений по правилам предназначен не для публики и не для Конгресса, а только для генерального прокурора.

Не допуская утечек из своего расследования, Мюллер перекрыл кислород потенциальному "Deep Throat". Журналисты отныне будут остерегаться публиковать утечки из разведки или контрразведки о российских контактах.

С другой стороны, если Мюллер нашел основания для импичмента, единственным легальным способом донести их до Конгресса было бы закрыть расследование и выпустить финальный отчет в надежде, что Конгресс сможет затребовать его по повестке. Это объясняло бы достаточно резкое окончание расследования до распутывания всех нитей.

Таким образом, остаются три варианта:

1. Расследование развалилось, не найдя доказательств преступной деятельности со стороны участников избирательной кампании Трампа.

2. Мюллер закрыл расследование для того, чтобы донести важную информацию до Конгресса и позволить начать процедуру импичмента.

In a 41-page opinion, Judge Dabney Friedrich, a Trump administration nominee to the U.S. District Court for the District of Columbia, struck down each of the arguments Concord Management and Consulting raised to contest Mueller’s authority.
“The appointment does not violate core separation-of-powers principles,” Friedrich wrote. “Nor has the special counsel exceeded his authority under the appointment order by investigating and prosecuting Concord.”

Last week, Miller was held in contempt of court for again ignoring the grand jury subpoena, a move Kamenar said was necessary in order to pursue his appeal.

This is all part of a effort to have a judge find that Mueller’s investigation is against the law.
Peter Flaherty, the chairman of the board of directors for the National Legal and Policy Center, told The Daily Beast that Miller is his group’s only Mueller-related client.
“We needed one client for this project and we have him,” he said. “We’re committed to paying all the costs associated with this Constitutional challenge.”

The Attorney General initiated a special proceeding to dissolve the Trump Foundation under court supervision and obtain restitution of $2.8 million and additional penalties. The AG’s lawsuit also seeks a ban from future service as a director of a New York not-for-profit of 10 years for Mr. Trump and one year for each of the Foundation’s other board members, Donald Trump Jr., Ivanka Trump, and Eric Trump. Можно вспомнить истерику, которую устроили республиканцы в 2016 после случайной встречи в аэропорту Билла Клинтона и генпрокурора Лоретты Линч. Из-за этой злополучной встречи Линч была вынуждена взять фактический самоотвод в расследовании Хиллари Клинтон, сказав, что примет рекомендацию ФБР. Это в свою очередь побудило директора ФБР Коми выступить с публичным заявлением об окончании расследования и в нарушении норм позволить себе критиковать объект расследования несмотря на отсутствие обвинения. Сделав это публичное выступление, Коми также посчитал себя вынужденным незадолго до выборов отправить в Конгресс злополучное письмо и тем самым изменил курс истории.

Ныне происходит не случайная встреча в аэропорту с Меланией Трамп. Объект криминального расследования вызывает прокурора на ковёр и требует предоставить информацию об этом расследовании, включая раскрытие конфиденциальных источников контрразведки. Трудно это квалифицировать иначе, чем грубое вмешательство в правосудие и злоупотребление служебным положением - как для покрытия преступников, так и для предательского подрыва национальной безопасности.

На прошлой неделе не было времени писать, но произошло множество интересных событий.

1. В понедельник не состоялись новые санкции, о которых накануне поспешила объявить Никки Хейли, посол США в ООН.

The day before US Ambassador to the UN Nikki Haley went on national television saying that new sanctions would be announced against Russia, the White House sent out a list of talking points to surrogates advocating such a move. But the day after she announced sanctions would be coming, the White House contradicted itself, abruptly saying it would not be following through with the sanctions.
CNN obtained an email distributed by the White House on Saturday morning, April 14, outlining the administration's response to an alleged chemical weapons attack in Syria. The talking points said, "We also intend to impose specific additional sanctions against Russia to respond to Moscow's ongoing support for the Assad regime, which has enabled the regime's atrocities against the Syrian people."

President Trump was watching television on Sunday when he saw Nikki R. Haley, his ambassador to the United Nations, announce that he would impose fresh sanctions on Russia. But the reference to Mr. Rosenstein’s actions in the memo — a much-disputed document that paints the investigation into Russian election meddling as tainted from the start — indicates that Republicans may be moving to seize on his role as they seek to undermine the inquiry.

Характерно то, что Трамп не вложил в проект ни копейки несмотря на то, что утверждал обратное, но получил с него деньги в неустановленном количестве за лицензию на использование своего имени.



Как отмечается в статье, есть множество параллелей с Trump SoHo в Нью-Йорке. Во-первых, нельзя не заметить след российской мафии. Алекс Шнайдер, главный инвестор проекта в Торонто, связан через отца и тестя с Солнцевской ОПГ и отмыванием денег КГБ. Отец Феликса Саттера, главного инициатора проекта SoHo, работал на Семена Могилевича. Во вторых, modus operandi в обоих случаях был одинаковый. Не вкладывая своих денег и не рискуя ничем, Трамп получал скромный гонорар за использование своего имени, беззастенчиво врал как про свои вложения, так и про успешность проекта, тем самым обманывая доверие инвесторов, после чего спокойно наблюдал за тем, как инвесторы теряют свои деньги, и успешно отбивался от обвинений в мошенничестве, используя дырки и связи в легальной системе.

This was particularly heinous because of the effect it had on the orphans. Russia did not allow the adoption of healthy children, just sick ones. In spite of this, American families came with big hearts and open arms, taking in children with HIV, Down syndrome, Spina Bifida and other serious ailments. They brought them to America, nursed them, cared for them and loved them. Since the Russian orphanage system did not have the resources to look after these children, many of those unlucky enough to remain in Russia would die before their 18th birthday. In practical terms, this meant that Vladimir Putin sentenced his own, most vulnerable and sick Russian orphans to death in order to protect corrupt officials in his regime.
Why did Vladimir Putin take such a drastic and malicious step?
For two reasons. First, since 2012 it’s emerged that Vladimir Putin was a beneficiary of the stolen $230 million that Sergei Magnitsky exposed. Recent revelations from the Panama Papers have shown that Putin’s closest childhood friend, Sergei Roldugin, a famous cellist, received $2 billion of funds from Russian oligarchs and the Russian state. It’s commonly understood that Mr. Roldugin received this money as an agent of Vladimir Putin. Information from the Panama Papers also links some money from the crime that Sergei Magnitsky discovered and exposed to Sergei Roldugin. Based on the language of the Magnitsky Act, this would make Putin personally subject to Magnitsky sanctions.
This is particularly worrying for Putin, because he is one of the richest men in the world. I estimate that he has accumulated $200 billion of ill-gotten gains from these types of operations over his 17 years in power. He keeps his money in the West and all of his money in the West is potentially exposed to asset freezes and confiscation. Therefore, he has a significant and very personal interest in finding a way to get rid of the Magnitsky sanctions.
The second reason why Putin reacted so badly to the passage of the Magnitsky Act is that it destroys the promise of impunity he’s given to all of his corrupt officials.

The Crown prosecutor of Russia met with his father Aras this morning and in their meeting offered to provide the Trump campaign with some official documents and information that would incriminate Hillary and her dealings with Russia and would be very useful to your father.
This is obviously very high level and sensitive information but is part of Russia and its government's support for Mr. Trump - helped along by Aras and Emin.
What do you think is the best way to handle this inforation and would you be able to speak to Emin about it directly?
I can also send this info to your father vis Rhona, but it is ultra sensitive so wanted to send to you first.

На практике "adding and abeiting" трактуется достаточно широко, хотя до сих пор не применялось в контексте выборов. Того, что мы уже знаем про то, как кампания Трампа использовала сливы Викиликс, достаточно для трактовки закона в сторону обвинения.

Одно из изменений, которые Трамп внёс в общественное мнение в США - представители адвокатской профессии из некогда презираемых людей превращаются в героев, пока страна начинает вспоминать о роли законов и законности. Один из таких героев - Ричард Пэйнтер, профессор права из Миннесоты и республиканец с многолетним стажем, который работал адвокатом по этике в последние два года администрации Буша.
